Refurbifi Trading Establishment mandates that all individuals and entities selling products on the Refurbifi website (referred to as the "Site") must provide buyers with the following limited warranty for products sold through the platform, known as the "Limited Warranty."

This Limited Warranty is not offered by Refurbifi but by the seller. As outlined in the Terms of Service, which can be found [here], Refurbifi serves as an intermediary and is never the seller or reseller of products. Consequently, Refurbifi is not liable for the products sold through the platform.

This Limited Warranty is specific to the original buyer and is non-transferrable with the product. You are not permitted to assign, transfer, or convey this Limited Warranty to another party. The capitalized terms within this Limited Warranty hold the definitions ascribed to them either (i) within this limited warranty agreement when defined, or (ii) in cases where no definition is provided here, as per the Terms of Sale, accessible on the refurbifi.com website.

1. What Does This Limited Warranty Cover?

This Limited Warranty grants you certain legal rights, and additional rights may apply, depending on your state's laws. Specifically, the seller assures the original buyer of the product on Refurbifi (as substantiated by a valid proof of purchase, such as a receipt or invoice) that the product will be free from defects in materials and workmanship during normal use for a period of 12 months from the delivery date (referred to as the "Warranty Period").

Any defect that manifests during the Warranty Period is assumed to have been present at the time of delivery. It is the seller's responsibility to establish that any damage falls outside the scope of this Limited Warranty or was not a pre-existing defect in the product upon delivery.

Furthermore, the seller will promptly process the return of the product within 24 hours after the buyer completes the online request and receives the approval from the seller/marketplace.

With this goal in mind, Refurbifi will provide a return label to the buyer, enabling them to return the product. The cost of this label will be covered by the seller if the buyer's claim falls within the scope of this Limited Warranty. In cases where it doesn't, the cost will be borne by the buyer.

The seller will provide the buyer with the choice of exchange, repair, or reimbursement within five business days from the receipt of the product(s) by the seller. It's important to note that in the case of an exchange or repair, the seller will cover the shipping cost for sending the replacement or repaired product to the buyer.

In the event of a product defect, subject to legal provisions, these are your only available remedies. However, for large or heavy products (i.e., those weighing more than 66 lbs or with dimensions exceeding 59 inches) and electric bikes, the seller has up to 30 days from the receipt of the product to offer an exchange or repair solution.

Please be aware that it is necessary to return the defective product in its original packaging or packaging that offers an equivalent level of protection, along with proof of purchase, to the address designated by the seller. Any replacement product will be covered under warranty for the remaining duration of the original warranty period.

2. What Is the Duration of the Coverage?

This Limited Warranty extends for a period of twelve (12) months, commencing from the date of the product's delivery to the buyer.

3. What Is Not Covered?

This Limited Warranty does not apply in the following scenarios:

Oxidized Products: Products that have undergone oxidation.

Damage or Failure Due to Accidents: Damage or failure resulting from an accident.

Unauthorized Component Manipulation: If one or several product components were manipulated by the buyer or a third party not authorized by the seller in connection with the defect for which warranty coverage is sought.

Misuse, Abuse, Neglect, and More: Damage or failures resulting from misuse, abuse, neglect, mishandling, misapplication, faulty installation, improper maintenance, or improper voltage supply.

Excessive Loss:Loss exceeding the original value or replacement value, whichever is lower, of the product.

Interference or Alteration: Damage or failure resulting from interference with or by other electronic devices, alteration, firmware flashing, or bios flashing.

Any product returned to the seller that falls outside the scope of this Limited Warranty may be handled as follows: rejected, returned at your expense (subject to prepayment, capped at 20% of the product price), or stored for sixty (60) days for your retrieval. After this period, the product may be disposed of at the seller's sole discretion, with no further liability or obligation to you.

4. Any Other Limitations?

4.1 Implied Warranties and Conditions:Unless prohibited by applicable law, all implied warranties and conditions, including those of merchantability and fitness for a particular purpose, shall be restricted to the duration of this Limited Warranty.

4.2 These limitations are enforceable to the extent allowed by law.

4.3 Limitation of Damages

Except where prohibited by applicable law, the seller shall not be held liable for any incidental, indirect, special, or consequential damages, or any loss of profits, revenue, or data. These damages may result from any breach of an express or implied warranty or condition, or under any other legal theory. This holds true even if the seller has been informed of the potential for such damages, and regardless of the form of action, whether in contract, tort (including negligence), or any other legal or equitable theory.

In certain jurisdictions, the exclusion or restriction of special, indirect, incidental, or consequential damages may not be permissible. Therefore, the aforementioned limitation or exclusion might not be applicable to you.

6. Is This Warranty an Insurance?

No, this Limited Warranty is not considered insurance, and it does not confer insured status or third-party beneficiary rights upon the buyer or any third party.

7. Governing Law

Arbitration and Dispute Resolution: Any disputes, differences, controversies, or claims arising in connection with these Terms, including matters concerning their existence, validity, or interpretation, shall be submitted for arbitration under the rules of the London Court of International Arbitration (LCIA). These Rules are considered incorporated by reference into this clause. English shall be the language utilized in the arbitral proceedings. A panel of three arbitrators shall be appointed by the LCIA Court in accordance with the Rules. The Parties also agree that the procedure for the expedited formation of the Arbitral Tribunal, as outlined in the Rules, shall be applicable. Any arbitral award rendered shall be considered final and binding on all parties and may be enforced in any court with competent jurisdiction.
